UNITED STATES OF AMERICA v. ROBERT LYLE BUCKHANNON and KELLY JANE DEMOSS
Defense attorneys for Robert L. Buckhannon and Kelly DeMoss are seeking to delay a federal criminal trial originally set to begin on November 27, 2018.
In a “Joint Unopposed Motion For An Ends Of Justice Continuance” filed on Friday, October 26, 2018 in U. S. District Court for the Western District of Michigan, attorneys for Buckhannon and DeMoss requested a continuance of 180 days.
In their joint motion, attorneys for the duo stated the voluminous discovery had identified “many potential witnesses and counsel will want to conduct interviews of relevant persons.”
Nearly five years after a suspicious fire destroyed the On Deck, a Battle Creek sports bar, its former owner, DeMoss (who now goes by Kelly Buksar Flees), and manager, Buckhannon (shown together in 2013 photo above), were indicted August 8, 2018 in federal court on various charges relating to a “conspiracy was to obtain money by means of false and fraudulent pretenses and representations to unlawfully enrich themselves, including by converting to their own personal use business loan proceeds fraudulently obtained from Blackburne that were intended for On Deck Sports Bar & Grill LLC”.
Assistant U. S. Attorney Christopher O'Connor, in a motion filed later that day, revealed the government did not oppose the six-month delay sought by Buckhannon and DeMoss.
