According to an order filed this afternoon (August 24), Steven Ingersoll's sentencing date has been pushed back from September 24 to October 20, 2015 at 8:30 a.m to accommodate a hearing on the government’s motion for restraining order and its motion to compel Ingersoll to produce "complete and accurate financial information". That hearing is scheduled for September 24 at at 2:30 p.m.
According to the order filed today by U. S. District Judge Thomas L. Ludington, on August 11, 2015, the court conducted an "in-person status conference" with counsel for both Ingersoll and co-defendant Roy C. Bradley, Sr. to address issues that may arise during sentencing.
The hearing focused on the "Presentence Investigation Report and associated information concerning Defendant Steven Ingersoll". Today's order stated that the presentence report for Bradley will be reviewed by Judge Ludington to "assess similar contested information" and the sentencing hearings for both defendants will be coordinated to avoid duplication.
Judge Ludington ordered both parties to provide a list of witnesses that will be called during the sentencing hearing and any documents/exhibits the witnesses may rely on during their testimony on or before September 11, 2015.
The witness list should briefly summarize the witness’s anticipated testimony and the anticipated amount of time for direct examination. Judge Ludington also directed both parties to exchange this information with each other.
In addition, Judge Ludington indicated that the attorneys for Ingersoll and Bradley may file a supplemental brief concerning "a defendant’s ability to provide testimony at sentencing that might contradict with a jury finding" on or before September 11, 2015. (The government's response is due on or before September 25, 2015.)
Ludington ordered that the parties’ briefs are not to exceed 10 pages.
